Sweeney pleads not guilty to DWI

Former U.S. Rep. John Sweeney Monday pleaded not guilty to a felony charge of driving while intoxicated, which will likely send the case to trial, said the Saratoga County district attorney.
Troy lawyer E. Stewart Jones, who is representing Sweeney, said Sweeney would lose his law license and therefore his livelihood if he is convicted of a felony, which would be disproportionate punishment, according to the Post-Star of Glens Falls.
Former N.Y. Judge Convicted of Attempted Extortion and Soliciting Bribes
Former New York Supreme Court Justice Thomas J. Spargo has been found guilty of attempting to shake down lawyers appearing before him to help pay the substantial legal bills he had incurred in fighting an ongoing investigation into his conduct by the Commission on Judicial Conduct.
At the close of a three-day trial in Albany, and after deliberating for seven hours, a Northern District of New York jury on Thursday convicted Spargo, 66, of both counts in the indictment against him: attempted extortion and soliciting a bribe.

Chef Larry Schepici closed his high-end downtown restaurant, an adjacent retail store and the Illium Cafe, on Sept. 21, apparently after a dispute with representatives of the state Department of Taxation and Finance.

ALBANY, N.Y. (AP) — A federal jury convicted a former New York state judge Thursday of attempted extortion and attempted soliciting of a bribe for pressuring a lawyer to give $10,000 to his defense fund.
Federal prosecutors said Thomas Spargo pressured the lawyer, who had cases pending before Spargo when he was a state Supreme Court justice in 2003, to help the judge cover legal bills from an ongoing battle with the state’s judicial discipline committee.
TROY — Tosca Grille is expected to soon reopen after attorney E. Stewart Jones and a group of area businesspeople joined together to pay the restaurant’s $14,000 in back taxes Friday.
Chef Larry Schepici voluntarily closed Tosca, along with Tosca Etc. and the Illium Café, on Sept. 21 due to financial issues. Records on file with the state Department of State revealed that Troy Food and Beverage Inc., a company operated in part by Schepici, owed nearly $60,000 in unpaid taxes, interest and penalties dating back to 2008.

As many as 35 people made donations to pay off the tax and vendor debts of Chef Larry Schepici, whose Tosca restaurant and Illium Cafe in Troy closed abruptly on Sept. 21 when he was unable to pay $14,000 in back sales taxes.
“We raised sufficient funds to pay off his tax debt and we expect to be able to manage his other financial issues, too,” says Troy attorney E. Stewart Jones, who is spearheading the effort.

Federal prosecutors said Thomas Spargo solicited the money from an Ulster County lawyer with cases pending before him when he was a state Supreme Court justice in 2003. They accused Spargo of pressuring the lawyer to contribute to his legal defense fund.

TROY — Emotions ran high at Rensselaer County Court Friday as a city woman was sentenced for stabbing her ex-boyfriend to death after an argument last May.
Kimberly Mayo, 39, was sentenced by Judge Robert Jacon to 10 years in state prison and five years post-release supervision after she pleaded guilty on Sept. 1 to charges of first-degree manslaughter and criminal weapon possession surrounding the May 21, 2008 stabbing death of Keith Levin.

Spargo allegedly tried to extort $10,000 from him to offset the judge’s growing legal fees in a judicial disciplinary case.Bruce Blatchly, who has been practicing law in New Paltz for 32 years, was the second witness to take the stand on the opening day of Spargo’s criminal trial in U.S. District Court in Albany.
